Terms of Service

By accessing or using GateKipas (the "Service"), operated by LawTekno LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, business owners, employees, and any other persons who access or use the Service in any capacity.

GateKipas is a cloud-based visitor and employee check-in management platform designed for small and medium-sized businesses. The Service includes but is not limited to: digital visitor check-in and checkout via a self-service kiosk; employee time tracking with secure 4-digit PIN and optional biometric (fingerprint/Face ID) authentication via WebAuthn; real-time host notifications delivered by email and SMS; multi-location management for up to 7 business locations; student management for schools, daycares, and tutoring centers; NDA and agreement signing during visitor check-in; emergency evacuation roster showing all checked-in visitors and clocked-in employees; analytics and reporting dashboards; custom branding with logos, themes, and accent colors; configurable custom fields for visitor data collection; and full bilingual support in English and French.

To use the Service, you must register for an account by providing accurate and complete information, including your business name, business type, full name, email address, and phone number. One account is permitted per business entity. You are responsible for maintaining the security and confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify LawTekno LLC immediately of any unauthorized use of your account or any other breach of security. You must be at least 18 years of age to create an account.

GateKipas offers a 14-day free trial that includes up to 50 visitor check-ins, 5 employees, and 1 custom field. No credit card is required to start the trial. At the end of the 14-day trial period, your account will be suspended unless you subscribe to a paid plan. Unused trial days are not transferable, refundable, or extendable. Trial accounts that are not converted to paid plans will have their data retained for 30 days following suspension, after which all data will be permanently deleted.

GateKipas offers two paid plans billed monthly through Stripe: the Starter plan at $10 per month (unlimited visitors, up to 15 employees, 3 custom fields, SMS notifications, custom branding) and the Pro plan at $25 per month (unlimited visitors and employees, unlimited custom fields, multi-location management up to 7 locations, biometric authentication, analytics, NDA/agreement signing, emergency features, and student management). By subscribing to a paid plan, you authorize LawTekno LLC to charge your selected payment method on a recurring monthly basis via Stripe. You are responsible for keeping your payment information current. You may cancel your subscription at any time through the Billing page in the dashboard or through the Stripe customer portal. Upon cancellation, your access continues until the end of the current billing period. We do not offer prorated refunds for partial billing periods.

You agree to use the Service only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations. You may not: use the Service for any illegal or unauthorized purpose; store sensitive personal data such as Social Security numbers, medical records, financial account numbers, or government-issued identification numbers in custom fields or notes; share your kiosk access credentials with unauthorized parties; attempt to gain unauthorized access to any part of the Service, other user accounts, or computer systems or networks connected to the Service; interfere with or disrupt the integrity or performance of the Service; use the Service to harass, abuse, or harm another person; upload viruses, malicious code, or any other harmful technology; or engage in automated data scraping, data mining, or similar data-gathering activities without express written consent.

You retain full ownership of all data you submit to the Service, including visitor logs, employee records, student records, agreements, and business information. LawTekno LLC does not claim any ownership rights over your data. We will never sell, license, or share your data with third parties for advertising or marketing purposes. You may export your data at any time through the dashboard in CSV format. You may also request deletion of your data at any time by contacting support. Data retention periods are configurable by business administrators through the Settings page, with options ranging from 6 to 60 months (default: 12 months). There is no unlimited retention option. Employee records may be retained longer in accordance with applicable labor laws. Upon account cancellation, all data is retained for 30 days to allow for reactivation, after which it is permanently and irrecoverably deleted from all systems.

GateKipas offers optional biometric authentication (fingerprint and Face ID) for employee clock-in via the WebAuthn standard, available exclusively on the Pro plan. Biometric data is handled as follows: explicit written consent is required from each employee before biometric enrollment, and the full consent text along with a precise timestamp is stored as a legal record; only WebAuthn credential identifiers and public keys are stored on our servers — raw biometric data such as fingerprints and facial scans never leaves the employee's device and is never transmitted to or stored on GateKipas servers; employees or business administrators can delete biometric credentials at any time through the dashboard; the biometric feature is entirely optional and can be enabled or disabled per organization at the administrator's discretion. GateKipas is designed to comply with the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and the Washington State biometric privacy law (RCW 19.375).

For education-type businesses (schools, daycares, and tutoring centers), GateKipas provides a student management module available on the Pro plan. Student records may include the student's name, grade or class level, student ID, guardian names and contact information (phone and email), authorized pickup persons, and notes (such as allergies, medical conditions, or special instructions). Guardian contact details, authorized pickup persons, and notes are never displayed on the public-facing kiosk. Only the student's name and grade are visible on the kiosk during the pickup flow. Access to student data is restricted by role: Admin and Manager roles can view and edit student records, while the Front Desk role can view but not modify student records. The Host role has no access to student data. GateKipas is designed to comply with the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA). The business (school or educational institution) is responsible for obtaining all required parental consents for the collection and use of student information.

GateKipas offers an emergency evacuation roster feature on the Pro plan that displays a real-time list of all currently checked-in visitors and clocked-in employees, along with their contact information and location. This feature is provided as an informational aid only. GateKipas is not a certified fire safety system, life safety system, or emergency management system. The accuracy of the evacuation roster depends on visitors and employees properly checking in and out. You should not rely solely on GateKipas for emergency evacuation procedures and should maintain your own emergency preparedness plans. LawTekno LLC is not liable for any injury, loss, or damage arising from reliance on the emergency evacuation feature.

LawTekno LLC may from time to time issue coupon codes that provide free access to a specified plan for a specified duration. When a coupon expires, the account will automatically revert to the Free Trial limitations unless the business subscribes to a paid plan. Coupons are non-transferable, have no cash value, and cannot be combined with other offers. LawTekno LLC reserves the right to revoke any coupon that is obtained or used fraudulently, and to modify or discontinue any promotional offer at any time without prior notice.

Pro plan subscribers can manage up to 7 business locations from a single account. Each location operates independently with its own kiosk, hosts, visitor log, employee roster, and settings. The headquarters (primary location) administrator has full visibility across all locations and can view aggregate data, transfer employees between locations, and manage branch settings. Staff assigned to a branch location can only access data for their own location. The maximum number of locations per account on the Pro plan is 7. By creating a GateKipas account, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. When we make material changes to these Terms, you will be prompted to review and accept the updated Terms upon your next login. If you do not accept the updated Terms, your access to the Service may be restricted until acceptance is provided.

LawTekno LLC aims to maintain 99.9% uptime for the Service but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance, system updates, or circumstances beyond our reasonable control including but not limited to natural disasters, power outages, and third-party service failures. LawTekno LLC is not liable for any loss or damage resulting from Service downtime or unavailability.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by applicable law, LawTekno LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the Service. The total aggregate liability of LawTekno LLC for any and all claims arising under or related to these Terms or the Service shall not exceed the total amount you have paid to LawTekno LLC in the twelve (12) months immediately preceding the event giving rise to the claim. GateKipas is not a security system, access control system, or surveillance system and should not be used as a substitute for such systems.

LawTekno LLC reserves the right to suspend or terminate your account at any time if you violate these Terms of Service, engage in fraudulent activity, or use the Service in a manner that could harm other users or the integrity of the Service. You may cancel your account at any time through the Billing page or by contacting support. Upon termination, your data will be retained for 30 days to allow for reactivation or data export, after which all data will be permanently deleted. Sections of these Terms that by their nature should survive termination (including but not limited to Limitation of Liability, Data Ownership, and Governing Law) shall survive any termination or expiration of these Terms.

LawTekno LLC reserves the right to modify these Terms of Service at any time. For material changes, we will provide at least 30 days advance notice by sending an email to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Service before the changes take effect.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Maryland, and you consent to the personal jurisdiction of such courts.
